TERMS OF SERVICE

By ordering a commission from me, @netflixandsapphire ("the Artist"), you ("the Client") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected/canceled commission with or without a refund, and/or a blacklist/public service announcement on any or all social media. Please note that these Terms of Service may be subject to change without prior notice.These Terms of Service are in effect as of MARCH 2024.

Section 1 - Will Draw

The Artist is willing to draw any of the following:

1.) Backgrounds, items, and logo designs following the complexity and style agreed upon prior2.) Original Characters and/or Fan Characters of any species, race, or ethnicity3.) Fanart that does not incite legal or moral trouble for the Artist.4.) Pin-up/Nudity of 18+ subjects5.) Moderate Gore (ex. blood, detached limbs, etc.)6.) Couple types(monogamous and/or polyamorous) of any sexuality or orientation engaging or involved in consensual romantic activity. This includes all physical affection that does not surpass "safe for work" guidelines.

8.) Real-life people under the condition that

1.) If alive: Expressed written/recorded permission of the subject in question is provided
2.) If dead: The Client was a family member of the subject or the subject had a large enough following to be considered recognizable by an audience in life
3.) Use of the subject's image does not incite legal or moral trouble for the Artist
(ex. political and/or religious figureheads, controversial celebrities, etc.)

Section 2 - Won't Draw

The Artist will not draw any of the following for a commission:

1.) Complex machinery (ex. exposed vehicle parts)2.) Heavy gore or dismemberment (ex. detailed internal body parts, etc.)3.) "Not Safe for Work" Sexual Content including but not limited to:

1.) Erect/interaction with/touching of genitalia
2.) Sexualized underage characters (in actual age or appearance)
3.) Pedophilic/incestuous relations
4.) Certain kinks/fetishes (ex. watersports, DDLG, noncon, emetophilia, zoophilia, etc.)

4.) Fanart of the following properties:

1.) Big Mouth
2.) Beavis and Butthead
3.) Robot Chicken
4.) Mad TV
5.) Cow and Chicken
6.) Ren & Stimpy

5.) Any sort of hateful content, such as racism, transphobia, homophobia, and characters with Nazi/Soviet/etc. imagery or paraphernalia.

Section 3 - Code of Conduct

1.) The Artist has a right to refuse the commission for whatever reason, with or without explanation.
2.) The Artist has a right to cancel the commission for whatever reason, with or without explanation.

3.) The Client has a right to cancel the commission for whatever reason, with or without explanation.

4.) The Artist has a right to upload the commission on any and/or all social media with proper credit unless specified by the Client beforehand to keep the commission private.5.) The Artist will not work with deadlines or rush orders unless discussed otherwise.6.) The Artist does not work on a "first come first serve" basis. Smaller commissions/commissions that do not take much time may be worked on in between larger commissions/commissions requiring more time.7.) The Client may contact the Artist at any time to ask for a progress check on the commission, but no more than 3-4 times every week. The Client is encouraged to contact the Artist via social media if the Client is unable to reach the Artist via e-mail.

Section 4 - Image Rights

1.) The Client may make edits to the completed commission as long as they abide by the rules of what the Artist is comfortable with being depicted as stated by the will/won't draw sections. (ex. cropping, adding text/borders, adjusting brightness, contrast, hue, and/or saturation...)2.) The Client may use/reupload the commission for personal/non-commercial use if proper credit to the Artist is given. A link back to one of the Artist's social media is encouraged but not necessary.

If the commission includes characters that do not belong to the Client, additional credit to the owner(s)/creator(s) of said characters must be provided when using/reuploading for personal/non-commercial use.

3.) The Client may not use the commission for any commercial use unless discussed with the Artist beforehand.

1.) Commissions for commercial use will be charged more than personal/non-commercial commissions.
2.) If the commission includes characters that do not belong to the Client, the Client can not use the commission for commercial use unless explicit written permission from the owner(s)/creator(s) of said characters is provided.

4.) The Client may not claim the commission solely as the Client's own work, whether The Client did or did not make any edits to the commission.5.) The Client may not claim the commission solely as another person's work, whether or not said additional person did or did not make any edits to the commission.6.) The Artist does not claim ownership to any of the characters/subjects portrayed in the commission. Characters belong to their respective owners. Proper credit to their creator/s should be given as portrayed in the creator/s own Terms of Service.

Section 5 - Delivery/Turn Around

1.) All commissions will be done in the style ordered in the sample unless otherwise stated.2.) All commissions will be formatted in either .PNG or .GIF with dimensions ranging from 50px - 3000px+ at 350 DPI, unless specified otherwise. Exceptions may be made depending on the commission.3.) The Client may request a specific canvas size or aspect ratio for a digital commission.

1.) Commissions with a canvas size larger than 3000px will have an additional charge.2.) The Client may ask for the commission to be a higher DPI if the Client plans to personally print the commission; however, there will be an additional charge.

4.) All commissions will be sent via e-mail/private message with the completed commission .PNG file attached. Animated files will be sent as a .GIF but may have their individual .PNG files attached upon request. The workable layer file/s for either commission type may also be attached if requested at the beginning of the creation process.5.) Unless specified not to upload the commission to the public, all commissions may be posted on the Artist's social media.

1.) Commissions may be posted on the Artist's social media after the Client has received and approved the original unmarked commission file.2.) The Client may choose to remain anonymous when the Artist publicly uploads the commission.3.) The Client may choose to be credited with the Client's own social medias in the description of the post when the Artist publicly uploads the commission.4.) If the Client does not specify to the Artist a contact method to promote, the credit will default to the account associated to the primary means of communication used throughout the commission. If the Client's primary communication is/was private, the Client will either be named or left anonymous. Emails and message service accounts are confidential and will only be shared in the event of a blacklist/public service announcement or upon the Client's request.

6.) Depending on the desired style and queue, the estimated turnaround is about one week. Expect to be updated every 2-5 business days with updates, likely in the form of work-in-progress (WIP) screenshots.

Section 6 - Payment

1.) Half payment is to be made upfront.2.) The rest of the payment is to be made after the Client has seen a thumbnail of the final.3.) Payment is to be made via PayPal unless the Client and Artist agree otherwise.

Previously accepted alternatives include CashApp, Venmo, Stripe, and purchasing of goods for the Artist by the Client. However, the Artist is allowed to decline alternative payments with or without explanation.

4.) Monetary payment is to be done in USD (United States Dollars).5.) Payment must be sent within 72 hours after confirmation unless otherwise discussed.6.) The Artist will only start working on the commission once the first payment has been confirmed.7.) The Artist will only send the Client the Client's finished commission once the Client's second and final payment has been confirmed.8.) The Client does not need to pay extra for any online platform service fees during either monetary transaction.

Section 7 - Refunds

1.) If the Client cancels the commission for whatever reason, the Client will receive a partial refund, depending on how much of the commission has been finished:

75% refund if the commission hasn't started
50% refund if in the sketch stage
25% refund if in the lineart stage
12% refund if in the base color stage
5% refund if in the shading stage/final touches

2.) The Client will not be refunded if the Client is unsatisfied with the finished commission.

1.) If the Client is unsatisfied with the commission, the Artist is willing to discuss and make minor edits (ex. adjusting colors), up to a maximum of 3 times after correspondence. Any desired major revisions (ex. reposing) will be rejected.2.) The only major revisions permitted are details that the Artist may have missed and was specified by the Client in the order form/correspondence while the commission was still in the sketching/lineart stage (ex. missing tattoo that's essential to the character's design).3.) The Client may commission another piece from the Artist if the Client so chooses with changes that will satisfy the Client. However, the Client will have to pay an additional fee agreed upon via discussion.

3.) The Client will not be entitled to receive any files of the commission if refunded.4.) If the Artist cancels the commission for whatever reason, the Client will receive a full refund, in addition to a .PNG/.GIF file of whatever progress of the commission has been completed.5.) Refunds will be given within 72 hours after correspondence unless otherwise discussed.

Section 8 - Step-by-Step Process

The following is a sample of the Artist's commission process:

1.) The Client orders a form using the social media comment/messaging feature where the commission is advertised. The Client's contact information will remain private and will not be shared.2.) The Artist contacts the Client within 72 hours after the Client has sent the order form, confirming the acceptance or rejection of the commission.3.) Upon acceptance, the final price and details of the commission are confirmed.4.) Payment information is discussed. Half payment is brought upfront.5.) The Client will receive a rough sketch of the commission. Any and all major revisions must be done at this stage.6.) Work-in-progress checkups will be made periodically by the Artist to ensure quality service.7.) Upon completion of the commission, the Client will receive a thumbnail screenshot of their finished commission. Once the Client's final payment has been made, all commission files will be sent via the Client's major contact.8.) If permitted, the Artist posts a resized and watermarked version of the commission on social media.
